Greater Autonomy for Women in Marriage

One of the most significant changes is the increased autonomy granted to women when it comes to marriage. Under the new law, women will no longer require a guardian’s approval to marry, allowing them to make independent decisions about their future.

Additionally, the legal minimum age for marriage will be set at 18 for both men and women, ensuring protection against underage marriages. In cases where there is an age gap of 30 years or more, particularly if the woman is marrying for the first time, court approval will be required. This aims to prevent any potential exploitation and ensure that both parties enter the marriage with full awareness and consent.

Major Child Custody Reforms: Putting Children First

For parents, the child custody laws are seeing a major overhaul, focusing on the well-being of the child above all else. The new legislation will extend custodial care until a child reaches 18 years old – a notable shift from the previous limits (11 for boys and 13 for girls).

A major addition to the law is that children aged 15 and above will have the right to choose which parent they wish to live with. This move ensures that their voices are heard and their preferences are considered in custody arrangements.

Additionally, strict penalties will be introduced for neglect, abuse, unauthorised travel, or mismanagement of a child’s financial assets, with fines ranging from AED 5,000 to AED 100,000 and potential imprisonment for serious violations.

Parental Rights & Travel Flexibility

The reforms also establish a more balanced approach to parental rights and responsibilities. Both parents will now have equal rights when it comes to traveling with their children for up to 60 days per year, with the possibility of extending this in special circumstances, such as medical treatments or other necessary situations.

In addition, both parents are expected to be involved in major decisions concerning their child’s education, healthcare, and upbringing, reinforcing a collaborative approach to co-parenting.

Simplified Legal Processes for Families

To improve efficiency and accessibility in family legal matters, the law introduces streamlined processes for dispute resolution. For instance, educational guardianship disputes will now be handled by the Urgent Matters Court, reducing lengthy delays in resolving such cases.

Moreover, parents will now have one year (instead of six months) to file custody claims, allowing for a more considerate and fair timeframe in dealing with sensitive family matters. Courts will also have the discretion to grant extensions in special cases to ensure that decisions are made in the best interest of the child.
